Terms of Service

1Acceptance of terms

By accessing or using the Iceberg website, platform, or related services (the “Services”), operated by Iceberg AI, Inc., a Delaware corporation (“Iceberg,” “we,” “us”), you agree to these Terms of Service. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to it.

2Use of the Services

The Services may be used only for lawful business purposes. You agree not to misuse the Services, interfere with their operation, attempt to access data or systems you are not authorized to access, or use the Services in violation of applicable law. Certain features let you connect third-party accounts (such as Google); actions taken through a connected account — such as sending a message you compose — are taken with your authorization, which you may revoke at any time.

3Customer data

Customer data — including customer-feedback data, content, and derived outputs supplied to or generated for a customer — remains the property of the customer. We process it to provide the Services and, where a separate agreement between the customer and Iceberg is in place, in accordance with that agreement. Our handling of personal information is described in our Privacy Policy.

4AI & third-party services

The Services use artificial intelligence to produce analyses, drafts, and suggestions. AI-generated content may be inaccurate or incomplete; it is provided for your review, and you are responsible for any content you approve, send, or publish. The Services also interoperate with third-party platforms and data sources, which are governed by their own terms and policies.

5Intellectual property

Iceberg and its licensors retain all right, title, and interest in and to the Services, including the platform, software, models, documentation, and any improvements. No rights are granted except as expressly set out in these terms or in a signed agreement.

6Disclaimers & liability

The Services are provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied, except as expressly stated in a signed agreement. To the fullest extent permitted by law, Iceberg will not be liable for indirect, incidental, special, consequential, or punitive damages, and our aggregate liability arising out of or relating to the Services will not exceed the amounts you paid for the Services in the twelve months preceding the claim (or one hundred U.S. dollars if none). Where a master services agreement is in place between you and Iceberg, its terms govern.

7General

You may stop using the Services at any time; we may suspend or terminate access for breach of these terms, security risk, or as required by law, and provisions that by their nature should survive — including ownership, disclaimers, and limitations of liability — survive termination. These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. We may update these terms from time to time; changes are reflected by the date above, and continued use of the Services after changes take effect constitutes acceptance.
